Philosophy: A Child Custody Attorney Special Master is a family law attorney who attempts to help parents resolve disputes about what is best for their children and who is empowered by the parties to recommend such decisions to the court. The primary purpose of an Attorney Special Master is to take difficult, quarrelsome conflicts out of the courtroom and to make those decisions the parties can’t on behalf of the children. The Attorney Special Master attempts to contain the chaos, and to get decisions made and implemented with a minimum of further damage to the children. Manner of handling: If it is safe, I hold an initial meeting with both (all) adult parties. This allows me to observe and experience their interaction. Thereafter, I may gather information from third parties, meet the children, hold joint meetings, hold individual meetings (by agreement of the parties), or exchange information by telephone (if there is a stipulation for ex parte communication), fax, e-mail, or snail mail, in whatever combinations work best for a particular family and/or particular issue. I am not a therapist. I do not attempt to provide an educational or therapeutic intervention, beyond whatever educational or therapeutic value there may be in modeling dispute resolution performed in a courteous, informed, and timely manner. When the parties cannot agree, I prepare a Recommendation. When I prepare a Recommendation, I try to give enough information, by way of a “Discussion” section to advise the parties, their attorneys, and ultimately the court, of the basis of the Recommendation. |
